“Carrier” means Starlink Cargo Inc, its employees, agents, and subcontractors.
“Shipper” means the sender, consignor, or customer who contracts the Carrier.
“Consignee” means the person or company to whom the shipment is addressed.
“Shipment” means one or more packages, pallets, or pieces tendered by the Shipper and
accepted by the Carrier under a single waybill.
The Carrier undertakes to transport shipments from Canada to the designated overseas destination, either directly or through third-party carriers, in accordance with these Terms & Conditions.
The Carrier does not accept hazardous goods, firearms, perishables requiring temperature control, live animals, currency, precious stones, or goods prohibited by law.
The Shipper must ensure proper packaging, labelling, accurate declarations, and compliance with customs / export & imports laws. The Shipper indemnifies the Carrier against penalties from false declarations or illegal shipments including cannabis , any type of cigarettes & alcohol.
Transit times are estimates only and not guaranteed unless specified in writing. The Carrier is not liable for delays due to customs, weather, or events outside its control.
Charges are based on the greater of actual or volumetric weight. Additional charges may apply for customs, storage or special handling. All charges are payable by the Shipper unless agreed otherwise.
The Carrier may act as the Shipper’s agent for customs clearance. Duties, taxes, and import fees at destination are the Consignee’s responsibility unless agreed otherwise.
The Carrier’s liability for loss is limited to CAD $25.00 per box or CAD $50 per shipment, whichever is greater, unless additional insurance is purchased. No liability for indirect losses. Claims must be made within 7 days.
Extra insurance coverage is available upon request and payment of premiums.
The Carrier reserves the right to inspect shipments for security, customs, or regulatory purposes.
The Carrier may subcontract services, with these Terms still applying.
The Carrier is not liable for delays/failures due to events beyond its control (natural disasters, strikes, war, embargoes, etc.).
These Terms are governed by the laws of the Province of Ontario and Canada. Disputes shall be resolved in Ontario courts.
